FICA Tip Credit
If your employees receive tips, you pay the employer's share of FICA tax on them, and much of that money can come back to you as a dollar-for-dollar federal tax credit. We calculate the FICA tip credit, file the forms and recover credits you may have missed in prior years.
How Nelson & Associates handles FICA Tip Credit
The FICA tip credit, under Section 45B of the Internal Revenue Code, gives food and beverage businesses a credit for the employer share of Social Security and Medicare taxes paid on tips above the amount needed to bring an employee up to the federal minimum wage of $5.15 an hour used for this calculation. For a busy restaurant, the credit can be worth tens of thousands of dollars a year.
Legislation enacted in 2025 extended the credit to businesses providing beauty services, such as barbering, hair care, nail care, esthetics and spa treatments, for tax years beginning after 2024. The credit is part of the general business credit, so unused amounts can generally be carried back one year and forward up to 20 years. Accurate tip reporting is the foundation, so we review your payroll records first.

FICA Tip Credit FAQs
6 answers to the questions clients ask most. Don’t see yours? Ask us directly.
Who qualifies for the FICA tip credit?
Employers in the food and beverage industry where tipping is customary, and, for tax years beginning after 2024, businesses providing qualifying beauty services. The tips must be reported by employees and the employer must have paid FICA tax on them.
How much is the credit worth?
Generally 7.65% of tips above the amount needed to bring each employee's pay up to $5.15 an hour. A restaurant with significant tipped staff can often claim a substantial annual credit.
Can I claim credits I missed in past years?
Usually yes, for years still open under the statute of limitations, by amending the business return. We review prior years as part of the engagement.
Does the credit reduce my deduction for payroll taxes?
Yes. You cannot deduct the portion of employer FICA tax that is used to compute the credit, but the credit is still worth far more than the lost deduction.
Is this the same as the new no-tax-on-tips deduction?
No. The FICA tip credit benefits the employer. The deduction for qualified tips created in 2025 benefits employees on their personal returns. We can explain how both apply to your business and staff.
Do you offer FICA Tip Credit outside Florida?
Yes. Our office is in Doral, Florida, and we work with clients across the United States and abroad through secure uploads, phone and video meetings and e-signatures. South Florida clients are welcome to meet with us in person.
