IRS Tax Problems & Resolution

IRS Levies

An IRS levy can freeze your bank account or take money owed to you without further warning. Speed matters. We contact the IRS, request release where you qualify and negotiate a solution that stops future levies.

Overview

How Nelson & Associates handles IRS Levies

Before levying, the IRS must send a Final Notice of Intent to Levy and give you 30 days to request a Collection Due Process hearing. After that, it can levy bank accounts, accounts receivable, retirement accounts, Social Security benefits and other property. Bank levies come with a 21-day holding period before the bank sends the money, which gives a short window to act.

The IRS must release a levy if it is creating an economic hardship, if the balance is paid, or if you enter an installment agreement, among other reasons. We move quickly to document hardship, propose a payment plan or other resolution and request the release.

  • Business owners whose customers received levy notices

Questions

IRS Levies FAQs

6 answers to the questions clients ask most. Don’t see yours? Ask us directly.

Ask a question

How quickly do I need to act on a bank levy?

Immediately. Banks generally hold levied funds for 21 days before sending them to the IRS, which is the best window to obtain a release.

Can the IRS take money from my business customers?

Yes. The IRS can levy accounts receivable by notifying your customers to pay the IRS instead of you.

Will the levy keep taking money?

A bank levy takes what is in the account on the day it's received. Wage and Social Security levies continue until released.

Can I get levied money back?

If the levy was wrongful or premature, or caused hardship, funds can sometimes be returned. Otherwise the focus is on stopping the next one.

Does an installment agreement stop levies?

Generally, yes. While a request for an installment agreement is pending or in effect, the IRS generally won't levy.

Do you offer IRS Levies outside Florida?

Yes. Our office is in Doral, Florida, and we work with clients across the United States and abroad through secure uploads, phone and video meetings and e-signatures. South Florida clients are welcome to meet with us in person.
