IRS Seizures
Property seizures are the IRS's most serious collection action. They are rare, they follow strict procedures, and with the right response they can often be prevented or reversed.
How Nelson & Associates handles IRS Seizures
Before seizing property, the IRS must send a final notice of intent to levy, give you the opportunity for a Collection Due Process hearing and, for your principal residence, obtain court approval. Revenue officers also must consider whether seizure makes sense compared with other collection options.
If you're facing a possible seizure, we act immediately: we contact the revenue officer, request a hearing or collection appeal, propose an alternative such as an installment agreement or offer in compromise, and, if property has already been seized, explore release or redemption options before a sale.

IRS Seizures FAQs
5 answers to the questions clients ask most. Don’t see yours? Ask us directly.
Can the IRS seize my home?
It's possible but rare. Seizing a principal residence requires approval from a federal court, and the IRS must first consider other ways to collect.
Can I get seized property back?
Property may be released before sale if you pay, agree to a plan or show the seizure was improper. After a sale, real estate can generally be redeemed within 180 days by paying the purchase price plus interest.
What should I do if a revenue officer contacts me?
Respond promptly and get representation. Revenue officers have strict deadlines, and early cooperation usually leads to better outcomes.
Does an offer in compromise stop a seizure?
Generally, the IRS suspends levy action while a qualifying offer is pending, though it doesn't apply to offers submitted solely to delay collection.
Do you offer IRS Seizures outside Florida?
