IRS Tax Problems & Resolution

IRS Wage Garnishment

An IRS wage garnishment can take a large share of every paycheck until the debt is resolved. We work to get the garnishment released and replace it with an affordable arrangement, often within a few weeks.

Overview

How Nelson & Associates handles IRS Wage Garnishment

Unlike most creditors, the IRS doesn't need a court order to garnish wages. A continuous wage levy stays in place until the balance is paid, the collection period expires or the IRS releases it. The amount you keep is based on your filing status and dependents, and it is often far less than what you need to live on.

We contact the IRS, verify the balance and prepare the financial information needed for an installment agreement, currently-not-collectible status or an offer in compromise. Once an acceptable arrangement is in place, the IRS issues a release to your employer.

Who this is for

  • People who received a final notice of intent to levy
  • Households struggling to cover basics after a garnishment

Questions

IRS Wage Garnishment FAQs

5 answers to the questions clients ask most. Don’t see yours? Ask us directly.

Ask a question

How much of my paycheck can the IRS take?

Everything above an exempt amount based on your standard deduction and number of dependents. For many people that leaves very little, which is why a fast release matters.

Will my employer find out why?

Your employer receives the levy notice, so they know there is an IRS levy, but not the details of your tax situation. We work to resolve it quickly.

Can a garnishment be stopped?

Yes. The IRS will release a wage levy when you enter an installment agreement, qualify for hardship status, pay the balance or meet other release criteria.

Do I need to file missing returns first?

Usually. The IRS generally requires all returns to be filed before agreeing to a payment plan or other resolution.

Do you offer IRS Wage Garnishment outside Florida?

Yes. Our office is in Doral, Florida, and we work with clients across the United States and abroad through secure uploads, phone and video meetings and e-signatures. South Florida clients are welcome to meet with us in person.
